1. Basic Terminology

Maa Upvan Holidays operates an online and offline platform under the brand Loveyatri.in, offering a range of farmhouses, villas, bungalows, and homestays for short‑stay bookings (“Properties”). These Properties are made available through the Loveyatri.in website, mobile app, third‑party websites, apps, travel agents, advertisements, referrals, or other channels (collectively, “Booking Channels”).

These Terms and Conditions apply to all guests or customers who book any Property or individual rooms through any of these Booking Channels. By making a booking, you agree to be bound by these Terms and Conditions. If you do not agree, you must not use the website or any Booking Channels to make a reservation.

Maa Upvan Holidays reserves the right to update or modify these Terms and Conditions at any time without prior notice. Updated terms will be effective immediately upon posting on Loveyatri.in. You are advised to review these Terms and Conditions regularly. Your continued use of the website or Booking Channels implies acceptance of any changes.

Unless additional terms are provided, these Terms and Conditions override all prior representations, agreements, or understandings and shall prevail in the event of any conflict, even if they differ from other terms related to any order placed or service provided by Maa Upvan Holidays.

For both online and offline bookings made through our platform, the following definitions apply:

(a) “Property/Properties”: Refers to farmhouses, villas,resorts, and homestays available for booking through any Booking Channels.

(b) “Guest/Guests”: Any individual, company, or entity interested in booking a Property through any Booking Channels. Guests may be referred to as “you” or “your”.

(c) “Booking”: A reservation made by a Guest for a Property for accommodation purposes.

(d) “Check‑In”: The scheduled date and time by which Guests must complete all check‑in formalities to begin using the reserved Property.

(e) “Check‑Out”: The scheduled date and time by which the Guest must vacate the Property after completing all check‑out formalities.

(f) “Booking Period”: The time between the scheduled Check‑In and Check‑Out.

(g) “Booking Amount”: The total amount payable by the Guest to Maa Upvan Holidays via the registered payment method to confirm the Booking, as communicated by Loveyatri.in.

(h) “Booking Confirmation”: Communication from Maa Upvan Holidays to the Guest upon receipt of the Advance (defined below), detailing the Booking, including names and number of Guests, Check‑In and Check‑Out details, Property name, number of rooms, Booking Amount, Security Deposit, and payment due dates.

Note: A Booking Confirmation does not guarantee a confirmed Booking until the full Booking Amount is received. The Booking Confirmation and proof of full payment must be presented at Check‑In.

(i) “Advance”: A non‑refundable deposit required to secure the Booking.

(j) “Security Deposit”: An amount that may be collected on a case‑by‑case basis and used to cover any damages to the Property or its contents by Guests or pets, or to recover other charges.

(k) “Peak Days”: Long weekends, festivals, and similar high‑demand periods such as Diwali, New Year, Christmas, etc.

2. Acknowledgement and Express Consent

Your use of the Loveyatri.in website, mobile app, or any Booking Channels is governed by these Terms and Conditions, our Privacy Policy, and all other policies published on the website. These documents form a binding agreement between you and Maa Upvan Holidays (Loveyatri.in).

By accessing, browsing, caching, storing, or otherwise using the website or its services, and by completing any Booking, you acknowledge that you have read, understood, and agreed to all the terms and conditions on the website (including the Privacy Policy) and agree to be bound by them.

The pages of this website, their content, infrastructure, and the online accommodation reservation services (“the Service/s”) are owned, operated, and provided by Loveyatri.in (Maa Upvan Holidays) and are intended for your personal, non‑commercial use only, subject to the terms herein.

3. Eligibility

The use of Booking Channels to make a reservation is restricted to individuals who can legally enter into binding contracts under the Indian Contract Act, 1872. Individuals deemed “incompetent to contract” under applicable Indian law are not eligible to use the Booking Channels.

4. Access and Interference for Online Bookings

Maa Upvan Holidays grants you a non‑exclusive, non‑transferable, limited permission to access and view the web pages of the website on your personal device. Any violation of the terms, conditions, or notices on the website will result in automatic termination of this limited permission, without prior notice.

You are not granted any express or implied rights or licenses under any patents, trademarks, copyrights, or other intellectual property rights unless expressly stated. You must not copy, scrape, mirror, or republish content without prior written consent. You agree not to use any software, device, or routine to interfere with the proper functioning of the website or any transactions.

You confirm that any information or files you upload or transmit will not contain viruses, Trojan horses, worms, or other harmful code.

5. Description of Services

Loveyatri.in functions as an online and offline platform for booking farmhouses and similar properties at competitive rates. The platform also provides information and images about these Properties.

While we strive to maintain accurate and up‑to‑date information, availability of amenities at a given time does not guarantee they will always be available. Maa Upvan Holidays reserves the right to discontinue or modify any amenity or service at its discretion, without prior notice.

6. Accuracy of Content

Every reasonable effort has been made to ensure the accuracy of rates, descriptions, and Property details on our Booking Channels. However, you acknowledge that Loveyatri.in will not be liable for any typographical, technical, or other errors that may appear on the website or app.

7. Additional Services

To enhance guest comfort, Maa Upvan Holidays may, at its discretion, arrange additional services such as chefs, cleaners, or vehicle hire through third‑party vendors, subject to availability and prior request.

These services are not included in the Booking Amount, Advance, or Security Deposit unless expressly stated. Additional charges may apply. Such services are provided only for the convenience of Guests and do not create any obligation or commitment on Maa Upvan Holidays.

8. Pricing

Rates listed on Loveyatri.in Booking Channels are non‑negotiable and may change at any time without prior notice. Tariffs are generally quoted per Property or per room, and may or may not include applicable taxes depending on the Property type.

If a technical error results in an incorrect rate being displayed, Maa Upvan Holidays reserves the right to correct the rate and the incorrect tariff will not be enforceable.

9. Right of Admission and Possession

By making a Booking, Guests acknowledge that they will never possess or claim ownership of any Property.

Check‑in is allowed only if all prescribed requirements are met, including:

Presenting the Booking Confirmation and proof of payment of the full Booking Amount.

Providing the original government‑issued photo ID and a copy for each Guest, as per government security norms.

Entering accurate details of all Guests (including children) in the Guest Register (physical or digital).

Guests under 18 must be accompanied by at least one adult. Providing false or incorrect information may result in immediate cancellation and denial of entry, or eviction if already checked in. In such cases, no refund of the Booking Amount, Advance, or Security Deposit will be given, and no compensation will be payable.

The total number of Guests (including visitors) must not exceed the number stated at the time of Booking. Additional persons may be allowed at Maa Upvan Holidays’ discretion and at an additional charge. No extra persons will be permitted without prior written approval.

10. Our Fees

Maa Upvan Holidays reserves the right to apply additional reservation or facilitation fees at any time, without prior notice to Guests.

11. User Terms

By using the website or making a Booking, you fully accept all risks related to the transaction and any subsequent activities connected to the booked accommodation.

12. Links to Other Websites

The website may contain links to third‑party websites. Maa Upvan Holidays does not endorse or control these sites and is not responsible for any claims arising from your use of them.

13. Promotional Offers

By sharing your contact details on the website, you agree to receive promotional content from Loveyatri.in via WhatsApp, email, SMS, or push notifications. Discounts and offers are subject to specific terms and conditions and may be modified or withdrawn at any time without notice.

14. Booking Confirmation

Guests understand that payment of the Advance and/or Security Deposit (if applicable) or receipt of a Booking Confirmation indicates acceptance of all Booking details and terms. However, a Booking Confirmation does not guarantee a confirmed booking unless the full Booking Amount is received by the due date.

If the full Booking Amount is not received by the specified due date, the Booking Confirmation will be cancelled, void, and unenforceable.

If a Booking is made through third‑party platforms, travel agents, or referrals, the Guest must confirm the Booking with Loveyatri.in. The terms of those third parties may apply in addition to these Terms and Conditions. In case of any conflict, the Terms and Conditions of Maa Upvan Holidays shall prevail.

15. Booking on Hold

Upon receipt of the Advance and Security Deposit (if applicable), the Booking will be placed on “Booking on Hold” status. The Booking will be confirmed only after the full Booking Amount is received through the designated payment method. If the full payment is not received by the due date, Maa Upvan Holidays is not obligated to fulfill the Booking.

16. Check‑In and Check‑Out Timing

Check‑In and Check‑Out times are specified in the Booking Confirmation. Guests are advised not to arrive before the scheduled Check‑In time, as early arrival may not be accommodated.

If a Guest enters before Check‑In, additional charges may apply. Any change to Check‑Out time must be approved in writing by Maa Upvan Holidays. Guests must vacate the Property by the Check‑Out time. Staying beyond this time may incur additional charges.

17. Advances, Security Deposit, and Property Damage

To secure a Booking, Guests must pay the Advance before the Booking Confirmation is issued. If the Advance is not received, the Booking may not be processed.

Guests must inspect the Property within 90 minutes of Check‑In and report any damage or defect. If no report is made within this period, any damage found later will be presumed to have occurred during the Guest’s stay, and the Guest will be liable.

Guests must use the Property and its furnishings with reasonable care. At Check‑Out, the Property must be left in good condition, with only normal wear and tear expected. If an item is part of a set and cannot be replaced individually, the Guest may be required to replace the entire set.

Guests must not move or relocate furniture, equipment, or decor without prior written consent, except for clearly movable items like chairs.

Security Deposit, if collected, will be refunded within 30 days of Check‑Out, after deducting any amounts for damages, missing items, or additional charges. The repair or replacement cost will be binding on the Guest. If the cost exceeds the Security Deposit, the balance will be billed and must be paid within 7 days. Refunds will be processed via bank transfer or as otherwise agreed.

18. Payment Options

Loveyatri.in accepts the following registered payment methods:

Credit/Debit Cards: Visa, Mastercard, RuPay, American Express, and other cards listed on the Booking Channels.

Net Banking: Payments via the Guest’s bank internet banking facility.

UPI: Payments via UPI apps like Google Pay, PhonePe, and Paytm are accepted.

Any bank or payment gateway fees are the responsibility of the Guest. Maa Upvan Holidays is not liable for such charges. If the full Booking Amount is not paid, the Booking will not be fulfilled.

19. Financial Details

You warrant that the credit/debit card or other financial details provided are accurate and lawfully owned by you. You must not use any financial facility that is not rightfully yours. Maa Upvan Holidays is not liable for any card fraud; responsibility for unauthorized use lies with the Guest.

20. Pets Policy

Pets may be allowed at some Properties, at the discretion of Maa Upvan Holidays. This will be clearly stated in the Booking Confirmation. A non‑refundable Pet Fee may apply.

If pets are brought without prior written approval or if unapproved pets are brought, they may not be allowed on the property, and Guests may be evicted. Approved pets must remain under the Guest’s control at all times, not be allowed in the swimming pool or on furniture, and must not cause damage or nuisance to neighbors.

21. Breach of Terms

Any violation of these Terms and Conditions may result in immediate termination of the Booking, eviction from the Property, and forfeiture of the entire Booking Amount or any other payments, without refund.

22. Cancellations and Refunds

Maa Upvan Holidays reserves the right to cancel any Booking at any time without prior notice. For detailed cancellation and refund rules, please refer to the Cancellation Policy page on Loveyatri.in.

23. Safety and Prohibitions

Guests must respect the residential character of the area and not disturb neighbors.

The Property must be used only for accommodation and lawful purposes.

No loud music or loud noises are allowed in outdoor areas (pool, garden, balcony, terrace, compound).

Guests must not use the Property for unlawful, immoral, or hazardous activities.

Possession, use, or consumption of prohibited drugs or organizing rave parties is strictly prohibited. Violation may lead to a police complaint being filed.

24. Confidentiality and Personal Data

All personal and booking information collected by Maa Upvan Holidays will be kept confidential in accordance with our Privacy Policy and applicable data protection laws, including the Information Technology Act, 2000 and related rules.

25. Intellectual Property Rights

All software, content, images, logos, and materials on or used by Loveyatri.in are owned by Maa Upvan Holidays. You must not copy, scrape, republish, or use any content for commercial purposes without prior written consent. Any unauthorized use will be treated as an infringement of our Intellectual Property Rights.

26. Limitation and Liability

Loveyatri.in functions as a booking and information platform and shall not be liable for:

Accidents, fires, injuries, or deaths occurring at the Property.

Any illegal or hazardous activities conducted by Guests or their companions.

Criminal acts such as theft, assault, drug use, or other unlawful behavior.

Structural or maintenance issues (cracks, leaks, paint, equipment, pool, etc.).

Guests must report any damage or issues to Maa Upvan Holidays immediately and before Check‑Out. Claims reported after Check‑Out may not be entertained. If liability is established, Maa Upvan Holidays’ liability will be limited to the Booking Amount paid by the Guest.

27. Guest Issues and Property Description

Maa Upvan Holidays makes every reasonable effort to provide accurate pictures and descriptions. However, if the Property description is materially inaccurate regarding size or features, Maa Upvan Holidays will not be liable for compensation.

If amenities such as pool, deck, hot tub, bathroom, appliances, or utilities (electricity, gas, water, Wi‑Fi) are not functioning properly, or if cleanliness or service is unsatisfactory, Guests must report the issue within 12 hours of Check‑In with supporting evidence (photos, etc.). Loveyatri.in will attempt to resolve the issue but is not liable for non‑resolution or for issuing refunds or compensation in such cases.

If the Property is occupied by others at Check‑In, Maa Upvan Holidays will make reasonable efforts to arrange an alternative Property of comparable size, rooms, and quality.

28. Force Majeure

Maa Upvan Holidays is not liable for any loss or damage arising from Force Majeure Events, such as strikes, natural disasters, pandemics, government orders, transport disruptions, or other events beyond our reasonable control.

29. Termination

Maa Upvan Holidays reserves the right to terminate your account or right to use the website or Booking Channels at any time, with or without notice, if you violate these Terms and Conditions or the Privacy Policy.

30. Dispute Resolution and Applicable Law

Any dispute arising from a Booking or these Terms and Conditions shall be referred to arbitration with a sole arbitrator in Hyderabad, under the Indian Arbitration and Conciliation Act, 1996. The proceedings shall be in English, and the decision of the arbitrator shall be final and binding. Courts in Hyderabad shall have jurisdiction.

31. Assignment

Bookings are non‑transferable; rights under a Booking cannot be assigned to another person or entity.

32. Notices

Notices from Maa Upvan Holidays to Guests will be sent via email (to the address provided) or posted on the website. Email notices are deemed delivered on the date sent.

33. Indemnification

Guests agree to indemnify and hold harmless Maa Upvan Holidays, its affiliates, employees, and agents from any loss, damage, or liability arising from:

Misuse of services.

Breach of these Terms and Conditions.

Use of the Property for commercial, unlawful, or unauthorized purposes.

This includes, but is not limited to, property damage, reputational harm, legal fees, and consequential losses.
